A CHARTER ORDINANCE EXEMPTING THE CITY OF CONWAY SPRINGS, SUMNER COUNTY, KANSAS, FROM K.S.A. 12-4104, INSOFAR AS IT PROHIBITS SEARCH WARRANTS BEING ISSUED OUT OF MUNICIPAL COURT FOR SAID CITY.

BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF CONWAY SPRINGS, KANSAS:

Section 1. The City of Conway Springs, Kansas, by the power vested in it by Article 12, Section 5 of the Constitution of the State of Kansas hereby elects to and does exempt itself and make inapplicable to it the provisions of K.S.A. 12-4104, insofar as said section prohibits search warrants being issued out of Conway Springs Municipal Court. K.S.A. 12-4104 is part of an enactment that does not apply uniformly to all cities, and the City elects to and hereby does provide substitute and additional provisions as hereinafter set forth in this ordinance.

Section 2. Hereafter, search warrants may issue out of a municipal court.

Section 3. Except as herein specifically provided, other provisions of K.S.A. 12-4104 not pertaining to the search warrants shall apply in all respects to the City of Conway Springs, Kansas.
